RENTAL AGREEMENTS & VOUCHERS  

 A Rental Agreement is prepared for signature by guests and owner prior to each rental. A sample form of agreement appears below (blanks "?" to be filled in as appropriate). Abbreviated forms of Rental Agreement, sometimes called "Rental Vouchers", may be issued to take the place of Rental Agreements and will refer to the contents of this Page to incorporate the terms of rentals. This sample form is typical of the rental agreement but  may be changed from time to time, without notice. In the event of differences between the terms of this sample agreement and those of the Rental Agreement, the terms of the latter shall govern.

OTHER TERMS & CONDITIONS

 

1. Effectivity.   This Agreement shall become effective when signed by both parties and delivered to Lessor, together with the Advance herein specified.  In the event any payment specified is not timely received by Lessor, the same may, without further notice or liability to Lessee, rent the property to another for the specified or any other period. . Entry on the premises shall constitute Lessor’s unconditional acceptance of the terms of this agreement.

 

2. Delivery & Redelivery.  On delivery to Lessee, the Rental Property shall be clean and free from any defect or deficiency preventing its use by Lessee as a temporary vacation residence. In the event defects exist or inventory items are missing upon such delivery, Lessee shall promptly notify Lessor. Failure to provide such notice shall bar Lessee's future claim or defense relative thereto. At the end of the rental period, Lessee shall remove all his personal items and redeliver the key and premises, including all inventory items, to Lessor, in the same condition as he received them. Any unauthorized overstay is deemed a trespass, for which the liquidated damages are € 200 per day/per person.

 

3. Lessee's Duty of Care; Key.  Lessee shall use due care in the use of the rental property, observe all posted House Rules and be considerate of the privacy and comfort of other residents or neighbours. Lessor's Agent may inspect during daytime hours. A single house key will be entrusted to Lessee upon arrival and must be returned to Lessor upon departure. Loss or other failure to return the key requires expensive re-keying of the outside locks, which will be charged to Lessee.  Lessee will designate a  "keeper of the key" or keep the key under his/her control at all times.

 

4. Rent, Security Deposit and other Charges.  All rent and deposit must be timely paid. The Security Deposit will be refunded within 10 days after the end of the rental period, if no damage or other expense (e.g. credit card company charges) is noted. Other charges payable by Lessee shall be paid to Lessor's Agent on or before the end of the rental period.  Phone/fax charges (in units) are metered on premises.  Charges for beverages are marked on each bottle.  If payment is tendered in currencies other than Euro (€), it will, in Lessor’s discretion, be converted to at the applicable “buy” exchange rate in effect on date of tender.  Lessor is authorized to charge all unpaid amounts to Lessee's credit card herein.

 

5. Changes, Cancellation and Cancellation Waiver.  Lessee may waive his cancellation rights by initialing here:  Lessor may treat Lessee's failure to make timely payments of any sum due hereunder as Lessee's cancellation.  A change in the reservation's dates is treated as a cancellation. All other changes hereto shall be in writing and bear the signature of both parties or their respective authorized representatives. Except as expressly authorized by Lessor in writing, occupancy shall not exceed the maximum number of persons shown on the obverse hereof. Occupancy by fewer than the number of persons specified herein does not entitle guest to a decreased rate; occupancy by more than such number, not exceeding 10, will be charged at €94 per person per week. Cancellation does not exonerate obligation to pay rent but may entitle Lessee to refunds. Either party may cancel this Agreement by giving written notice to the other party, whereupon, except as herein provided, amounts theretofore paid hereunder shall be refunded. In no event shall Lessor’s liability for cancellation exceed such refund. Upon Lessee's cancellation more than 4 months before the start of the rental period, 10% of the total rental amount shall be withheld from the refund; upon such cancellation within 4 months of the start of such period, there shall be no rental refund unless the premises are re-rented for the same period, in which case, Lessor shall refund the rental deposits collected, less 35% of Lessee's total rental amount, but in no event in excess of the rental amount actually paid Lessor on re-rent. Except upon Lessor's cancellation, an administrative fee of €100 or equivalent in the currency specified shall be deducted from all refunds...

 

6. Late Arrivals; Early Departures.  Should Lessee's time of arrival to or departure from the premises change, Lessee shall notify Lessor or Lessor's Agent accordingly. Neither arrival later than the start of the rental period nor departure earlier that the end of the rental period shall entitle Lessee to any adjustment or refund.

 

7. Joint and several Liability.  All persons signing this Agreement on behalf of Lessee shall be jointly and severally liable under this Agreement for their acts or omissions as well as for the acts or omissions of all persons allowed by them, or any of them, to enter the premises during the rental period.  Subletting is not allowed.

 

8. Notices; Applicable Law and Venue.  Notices to Lessor are to be addressed to: Yvon Heckscher c/o DISCA, 10940 Peaks Pike, Sebastopol , CA 95472, USA . Notices to Lessee are to be addressed to Lessee's address as set forth on page 1 hereof.  Unless otherwise expressly provided, the laws of Switzerland shall govern this Agreement, and the courts thereof shall have exclusive jurisdiction over all matters referring to it.  This document is the entire agreement, but may be issued in duplicates which shall constitute only one agreement.

 

9. Miscellaneous.

          (a) Owners' Areas.  The following areas and all equipment therein are excluded from the rented premises and  equipment: (a) attics, (b) portions of garage occupied by Lessor's vehicles, (c) Boiler room, (d) nuclear shelter.

          (b) Disclaimers.  Lessor shall not be liable for disruptions or malfunction of  rented equipment.

          (c) Smoking. Smoking is not allowed on the premises, except on balconies, terrace and other outside areas.

              (e) Infant Restraint..  A device restraining infants from access to stairs is available without charge. .Lessee with infant(s)  initial here     if desired or    if not desired.

             (f)  Pets are welcome (1 to a family) but must be kept in the heated garage when they are not supervised by an adult member of Lessee's group.
